Under D.C. Code § 42-3541.01 et seq. § 42-3541.08, a housing provider is shielded from legal claims arising out of what it knew—or should have known—about an applicant's criminal history, so long as that knowledge came from a lawful inquiry under the chapter and the applicant ultimately became a tenant or occupant. This immunity provision limits the legal exposure that could otherwise follow from using criminal-background information in the housing application process. The protection applies only when the specific conditions of the statute are met, including that the person actually moved in as a tenant or occupant.

For Property Managers

Housing providers operating under D.C. Code § 42-3541.01 et seq. § 42-3541.08 generally document that any criminal-history inquiry was conducted in compliance with the chapter's requirements and that the applicant subsequently became a tenant or occupant, since both conditions are necessary for the immunity to apply. Compliant operators typically maintain records showing the timing and scope of any background inquiry relative to the applicant's tenancy status. Understanding the boundaries of this immunity provision helps operators assess how criminal-history information may be used within the framework the chapter establishes.

For Tenants

D.C. Code § 42-3541.01 et seq. § 42-3541.08 grants housing providers immunity from certain claims tied to criminal-history information, but only when that information was gathered through a lawful inquiry under the chapter and the applicant became a tenant or occupant. Tenants and applicants who believe a housing provider conducted a criminal-background inquiry outside the chapter's rules may have grounds to raise that issue, since the immunity does not extend to inquiries that fall outside the statute's scope. Tenant-rights organizations in the District of Columbia can help individuals understand how this provision interacts with other protections available under the chapter.
