D.C. Code tit. 42 § 42-3404.05a
Template agreements and contracts; filing with department.
Operative Text
(a) No agreement or contract entered into under this subchapter , including development agreements, shall be deemed valid or enforceable unless the information specified in this section is filed with the Department within 30 days after signature by all parties. Information submitted to the Department shall include: (1) Address and ward; (2) Unit count; (3) Sales price; (4) Information related to rent-stabilization; (5) Information related to income-restricted units and subsidies; and (6) Other information as determined by the Department. (b) No later than [June 29, 2026], the Department, pursuant to subchapter I of Chapter 5 of Title 2 , shall issue rules to establish: (1) A standard template for purchase contracts; and (2) Rules governing the minimum information required to be included in a purchase contract. (c) The use of templates established pursuant to subsection (b) shall not be mandatory for the execution of an agreement governed by this chapter .
Under D.C. Code § 42-3401.01 et seq. § 42-3404.05a, any agreement or contract made under this subchapter — including development agreements — is not considered valid or enforceable unless specific information is filed with the Department within 30 days of all parties signing. Required filings include the property address and ward, unit count, sales price, rent-stabilization details, and information about income-restricted units and subsidies. Separately, the Department is directed to create standard purchase-contract templates and minimum-content rules by June 29, 2026, though use of those templates is not mandatory.

Property owners and managers operating under D.C. Code § 42-3401.01 et seq. § 42-3404.05a generally ensure that every covered agreement or contract is accompanied by a timely filing with the Department — submitted within 30 days of the final signature — containing all required data points such as address, ward, unit count, sales price, rent-stabilization information, and subsidy details. Operators typically track signature dates carefully, since an unfiled agreement risks being deemed invalid or unenforceable. Once the Department issues its template and minimum-content rules (no later than June 29, 2026), compliant operators review those rules even though template use remains optional.

Under D.C. Code § 42-3401.01 et seq. § 42-3404.05a, tenants in buildings subject to this subchapter have an interest in whether agreements affecting their housing — such as development or purchase contracts — were properly filed with the Department within 30 days of execution. If a covered agreement was never filed, it may be unenforceable, which can be relevant to understanding the legal standing of transactions that affect tenant rights. Tenants who have questions about whether a specific agreement was filed can contact the Department directly, consult a tenant-rights organization in the District, or explore whether the filing status can be raised in any applicable administrative or legal proceeding.
