31 Del. C. §§ 4313, 4315, 4323 § 4323
Inspection of housing projects located within the City of Wilmington
Operative Text
(a) Every dwelling, apartment or other living accommodation owned or managed by the Wilmington Housing Authority and located within the City of Wilmington shall be subject to the comprehensive development plan, including the housing component thereof, and the planning, zoning, sanitary and building laws, ordinances and regulations of the City of Wilmington. (b) No dwelling, apartment or other living accommodation owned or managed by the Wilmington Housing Authority and located within the City of Wilmington shall be given a Certificate of Occupancy after January 1, 2000, until such property has been determined to be in compliance with the applicable codes, ordinances and regulations of the City of Wilmington as determined by the Department of Licensing and Inspection.
Under 31 Del. C. §§ 4313, 4315, and 4323, dwellings, apartments, and other living accommodations owned or managed by the Wilmington Housing Authority within Wilmington city limits are subject to the city's comprehensive development plan, as well as its planning, zoning, sanitary, and building laws. Additionally, any such property seeking a Certificate of Occupancy after January 1, 2000, must first be found compliant with applicable city codes, ordinances, and regulations by the Department of Licensing and Inspection. This provision ensures that Wilmington Housing Authority properties are held to the same municipal standards as other residential properties in the city.

Operators and managers of Wilmington Housing Authority properties should be aware that, under 31 Del. C. §§ 4313, 4315, and 4323, all such properties within Wilmington are governed by the city's full suite of planning, zoning, sanitary, and building regulations. Before any covered property can receive a Certificate of Occupancy, the Department of Licensing and Inspection must formally determine that the property meets all applicable city codes and ordinances. Compliant operators typically ensure inspections are scheduled and all identified deficiencies are resolved prior to seeking occupancy certification.

Tenants living in or seeking housing in Wilmington Housing Authority properties have an interest in knowing that, under 31 Del. C. §§ 4313, 4315, and 4323, those properties must comply with Wilmington's planning, zoning, sanitary, and building regulations, and cannot lawfully receive a Certificate of Occupancy after January 1, 2000, without a sign-off from the Department of Licensing and Inspection. If a tenant has concerns about whether a property has met these requirements, they may contact the Department of Licensing and Inspection to inquire about a property's compliance status. Tenant-rights organizations in Delaware can also help residents understand what these standards mean for their housing situation.
