25 Del. C. ch. 71 § 7109
Rights of nonpurchasing tenants
Operative Text
(a) All manufactured home sites occupied by nonpurchasing tenants shall be managed by the same manager or agent who manages all other units in the manufactured home community. The owner shall provide to nonpurchasing tenants all services and facilities required by law on a nondiscriminatory basis. The owner shall guarantee such obligation of the manager or agent to provide all such services and facilities for each tenant until such time as the tenant no longer resides on the premises. This obligation will be the obligation of the tenants’ association if it exercises its right of first refusal and purchases the community. (b) Where an owner has given notice of that owner’s intent to convert a manufactured home community, each tenant who has not purchased a unit in the proposed conversion project shall, during the remaining term of the rental agreement and any extension thereof, be entitled to the same rights, privileges and services that were enjoyed by tenants prior to the date of the preliminary notice together with those that are granted, offered or provided to purchasers or prospective purchasers of the conversion project.
Delaware Code 25 Del. C. ch. 71 § 7109 establishes protections for manufactured home community residents who choose not to purchase their lot during a conversion. Under subsection (a), the same manager or agent who oversees the broader community must continue managing sites occupied by nonpurchasing tenants, and all legally required services and facilities must be provided without discrimination. Under subsection (b), once an owner announces an intent to convert the community, tenants who do not buy in retain the same rights, privileges, and services they had before the notice was given — and are also entitled to any benefits extended to buyers or prospective buyers — for the duration of their rental agreement and any extensions.

Operators of manufactured home communities in Delaware should be aware that § 7109 requires consistent management and nondiscriminatory service delivery for all nonpurchasing tenants throughout any conversion process. A compliant owner ensures that the same manager or agent responsible for the broader community continues to serve nonpurchasing residents, and that no services or facilities are reduced or withheld once a conversion notice has been issued. Owners also take care to extend to nonpurchasing tenants any rights, privileges, or amenities offered to purchasers or prospective purchasers during the conversion period, and should note that if a tenants' association exercises a right of first refusal, these service obligations transfer to that association.

Under 25 Del. C. ch. 71 § 7109, Delaware manufactured home community residents who choose not to purchase during a conversion are entitled to continued, nondiscriminatory management and services for the full remaining term of their rental agreement and any extensions. If an owner announces a conversion and you have not purchased a unit, you are entitled to at least the same level of services and rights you had before that notice — and to any additional benefits offered to buyers. Tenants who believe these protections are being violated may consider documenting the changes in services, raising the violation as a defense in any related legal proceeding, or reaching out to a local tenant-rights organization for general guidance on available options.
