25 Del. C. ch. 70 § 7051
Rent increase; notice
Operative Text
(a) A community owner may not increase a tenant’s lot rent more than once during any 12-month period, regardless of the term of the tenancy or the term of the rental agreement. (b) A community owner may only increase rent if the rent increase complies with all of the following: (1) Any lease provision providing for a specific amount of rent for a specific period of time. (2) The applicable requirements of this chapter. (c) (1) A community owner must provide written notice of a rent increase at least 90 days, but no more than 120 days, before the first day the increased amount of rent is due, to all of the following: a. Each affected homeowner. b. The homeowners’ association, if 1 exists. c. DEMHRA. (2) The notice under paragraph (c)(1) of this section must identify all affected homeowners by lot number, name, group, or phase. If the affected homeowners are not identified by name, the community owner shall make the names and addresses available, upon request, to any affected homeowner, homeowners’ association, or DEMHRA.
Under 25 Del. C. ch. 70 § 7051, a manufactured-home community owner in Delaware is limited to one lot-rent increase per 12-month period, no matter how the lease is structured. Any increase must conform to the terms of the existing lease and the broader requirements of Chapter 70. Before the increase takes effect, written notice must be delivered to each affected homeowner, the homeowners' association (if one exists), and DEMHRA, within a window of 90 to 120 days before the first day the higher rent is due.

Operators subject to 25 Del. C. ch. 70 § 7051 generally ensure that no lot-rent increase is issued more than once within any rolling 12-month window and that any proposed increase is consistent with existing lease terms. Written notice is typically prepared and distributed between 90 and 120 days before the effective date, addressed to every affected homeowner (identified by lot number, name, group, or phase), the homeowners' association if one is active, and DEMHRA. When homeowners are not identified by name in the notice, compliant operators keep a list of names and addresses available upon request to any affected homeowner, the association, or DEMHRA.

Section 7051 of Title 25, Chapter 70 of the Delaware Code gives manufactured-home community residents the right to receive written notice of any lot-rent increase at least 90 days—but no more than 120 days—before the new amount is first due. Tenants can verify that an increase complies with this rule by checking whether it arrives within that window, whether it has already been less than 12 months since the last increase, and whether it aligns with any fixed-rent period in their lease. Residents who believe a notice or increase does not meet these requirements may contact DEMHRA, reach out to a local tenant-rights organization, or consult an attorney familiar with Delaware manufactured-housing law for general information about available options.
