25 Del. C. ch. 70 § 7030
Right of first offer; offer of an alternative price
Operative Text
(a) An alternative offer of price for the sale, transfer, or conveyance of the community from the homeowner association remains valid for 6 months, unless withdrawn by the homeowner association in writing and sent to the community owner by overnight service with signature receipt. If the community is still for sale at the expiration of the initial 6-month alternative offer period, the homeowners association shall have the right to refresh their alternative offer within 7 days of its expiration upon written notice to the community owner. The refreshed offer will be valid for 6 months. The homeowners association shall have the right to refresh their offer every 6 months until the property is sold or 18 months has elapsed from the time notice was provided under § 7027(a) of this title, whichever comes first. The alternative offer and any refreshed alternative offer may be amended at any time upon written notice to the community owner. In the event a community owner decides they no longer want to sell a community after having provided the homeowners association with the notice of first offer, any outstanding alternative offer shall be void. The community owner shall promptly notify the homeowners association of their decision to remove the community from the market. (b) A notice to withdraw an alternative offer must be approved by the members of the homeowners association. The approval percentage must be stated in the notice to the community owner.
Under 25 Del. C. ch. 70 § 7030, when a manufactured-home community is listed for sale, the homeowners association may submit an alternative purchase price offer that stays open for six months. The association can refresh that offer every six months—up to a total of 18 months from the original notice—as long as the community remains on the market. If the community owner decides to pull the property off the market entirely, any outstanding offer from the association automatically becomes void, and the owner must promptly inform the association of that decision.
Plain English — not legal advice.
Under § 7030, community owners dealing with an active alternative offer from a homeowners association should maintain clear written records of all communications, including any decision to withdraw the property from sale. A compliant operator promptly notifies the homeowners association in writing when the community is removed from the market, ensuring no ambiguity about the status of any outstanding offer. Owners should also be aware that any sale or transfer to a third party during the offer period must account for the association's ongoing right to refresh its alternative offer within the 18-month window.

Section 7030 gives the homeowners association—which represents residents of the community—a sustained right to keep an alternative purchase offer on the table for up to 18 months while the community is listed for sale. If the association votes to withdraw its offer, that decision must be member-approved and documented with the required approval percentage sent to the community owner. Residents who want to understand how this process affects their community can consult their association's governing documents, reach out to a tenant-rights or manufactured-housing advocacy organization, or review the full provisions of 25 Del. C. ch. 70 for additional context.
