25 Del. C. ch. 70 § 7022C
Recreational vehicle leases
Operative Text
No community owner may issue a lot lease for the rental of ground in a manufactured home community upon which a camper trailer, recreational vehicle, motor home, or similar vehicle or trailer is placed or shall be placed if the community owner knows or should know that the vehicle or trailer is likely to be used as the tenant’s primary residence. This prohibition does not apply to lot leases issued to tenants who are current residents in the community and for whom the vehicle or trailer in question is their primary residence.
Under 25 Del. C. ch. 70 § 7022C, a manufactured home community owner is prohibited from issuing a new lot lease for ground on which a camper trailer, recreational vehicle, motor home, or similar vehicle is placed—or will be placed—when the owner knows or reasonably should know that the vehicle will serve as the tenant's primary residence. However, this prohibition contains a specific carve-out: it does not apply to lot leases issued to tenants who are already living in the community and are currently using such a vehicle as their primary residence. The rule draws a line between new arrangements that would establish primary-residence use and existing arrangements where that use is already in place.
Plain English — not legal advice.
Community owners operating under 25 Del. C. ch. 70 § 7022C generally review the intended use of any vehicle or trailer before issuing a new lot lease, since the statute imposes a knowledge standard—covering both actual knowledge and what the owner 'should know.' Compliant operators typically document the purpose for which a prospective tenant intends to use the vehicle and decline to issue lot leases when primary-residence use is apparent or reasonably foreseeable. Owners should also be aware that the prohibition does not require them to disturb existing leases held by current residents who are already using such a vehicle as their primary home.

Under 25 Del. C. ch. 70 § 7022C, tenants who are current residents of a manufactured home community and are already using a camper trailer, recreational vehicle, or similar vehicle as their primary residence have an explicit statutory protection: the prohibition on lot leases does not apply to their situation. Prospective tenants who believe a community owner has improperly denied or structured a lease arrangement based on intended primary-residence use may wish to consult a tenant-rights organization or legal aid provider familiar with Delaware landlord-tenant law. Reviewing the full text of Chapter 70 of Title 25 of the Delaware Code can help clarify what rights and remedies may be available.
