25 Del. C. ch. 70 § 7004
Exemptions
Operative Text
(a) Except for homes defined as “manufactured homes” in § 7003(13) of this title, the rental of ground upon which a recreational vehicle is placed, including any facilities or utilities thereon, is exempt from the requirements of subchapters I through V of this chapter and nothing in subchapters I through V of this chapter may be construed as determining, regulating, or governing the legal rights of parties to any lease or rental agreement for the ground on which a recreational vehicle is situated. (b) The rental of ground within the category of seasonal property is exempt from the requirements of subchapters I through V of this chapter and nothing in subchapters I through V of this chapter may be construed as determining, regulating, or governing the legal rights of parties to any lease or rental agreement for the rental of ground within the category of seasonal property.
Delaware Code § 7004 carves out two categories of rental arrangements from the protections and requirements found in subchapters I through V of Chapter 70. First, the rental of land on which a recreational vehicle is placed—along with any associated facilities or utilities—falls outside those subchapters, unless the vehicle qualifies as a 'manufactured home' under § 7003(13). Second, the rental of ground classified as seasonal property is similarly excluded, meaning the legal rights of parties to such seasonal rental agreements are not determined or governed by those subchapters.
Plain English — not legal advice.
Operators who rent land for recreational vehicle placement or who rent ground classified as seasonal property should be aware that § 7004 places those arrangements outside the regulatory framework of subchapters I through V of Chapter 70. Compliant operators in these categories generally rely on the terms of their individual lease or rental agreements to define the parties' rights, since the statutory protections and obligations of those subchapters do not apply. One important exception applies: if a vehicle on the rented ground meets the definition of a 'manufactured home' under § 7003(13), the exemption does not apply and the full chapter requirements would govern.

Under § 7004, tenants renting land for a recreational vehicle or renting ground classified as seasonal property generally do not have access to the rights and protections established in subchapters I through V of Chapter 70. However, if the vehicle on the rented land qualifies as a 'manufactured home' as defined in § 7003(13), the exemption does not apply and those subchapter protections may be available. Tenants uncertain about whether their arrangement qualifies as exempt may find it helpful to consult a tenant-rights organization or legal aid service familiar with Delaware housing law.
