25 Del. C. ch. 54 § 5412
Reports
Operative Text
(a) Beginning after [the implementation date under 85 Del. Laws, c. 98, § 5(2)], the Department shall create an annual report with the following information: (1) The total number of certificates filed with the Department. (2) The number of certificate deferrals issued by the Department and the basis for the deferrals. (3) The number of certificate deferral requests that were denied and the reason for the denials. (4) Any violations or civil penalties issued by the Department under this chapter. (5) The number of inspections that disclosed a lead-based paint hazard. (b) The Department shall submit the annual report under subsection (a) of this section to the Governor, the General Assembly, and the Director and the Librarian of the Division of Research of Legislative Council not later than January 1.
Under 25 Del. C. ch. 54 § 5412, Delaware's Department of Health and Social Services (or the designated Department) is required to compile and publish an annual report covering key data points related to lead-based paint hazard certificates. The report must include totals for certificates filed, deferrals granted or denied, any violations or civil penalties issued under the chapter, and the number of inspections that uncovered lead-based paint hazards. Each year, this report must be delivered to the Governor, the General Assembly, and the Division of Research of Legislative Council no later than January 1.

Property owners and managers operating under Delaware's lead-based paint certificate requirements should be aware that, per 25 Del. C. ch. 54 § 5412, the Department tracks and publicly reports certificate filings, deferrals, denials, violations, and civil penalties on an annual basis. Compliant operators generally ensure their certificate filings are accurate and timely, since those filings feed directly into the data the Department compiles. Because violations and civil penalties are specifically included in the annual report, a record of non-compliance becomes part of a publicly submitted government document reviewed by the Governor and General Assembly.

Section 5412 of 25 Del. C. ch. 54 gives tenants an important transparency tool: the Department's annual report, submitted each year by January 1, documents how many lead-based paint hazard inspections were conducted, how many hazards were found, and what violations or civil penalties were issued. Tenants concerned about lead hazards in their rental unit can reference this publicly submitted report to understand enforcement trends in the state. Those seeking more information about their specific building's certificate status or a landlord's compliance history may consider contacting the Department directly, reaching out to a tenant-rights organization, or consulting an attorney familiar with Delaware housing law.
