Operative Text
(a) For each lodging establishment, newly erected, built, or constructed after January 1, 2019, the carbon monoxide detection devices required under § 6602C of this title must be installed at the time of construction. (b) For each lodging establishment, in the process of being erected, built, or constructed as of January 1, 2019, the carbon monoxide detection devices required under § 6602C of this title must be installed before December 31, 2019, or the completion of construction. (c) For each existing lodging establishment, erected, built, or constructed before January 1, 2019, the carbon monoxide detection devices required under § 6602C of this title must be installed before December 31, 2020.
Section 6604C of Title 16 of the Delaware Code establishes phased compliance deadlines for installing carbon monoxide detection devices in lodging establishments. Buildings newly constructed after January 1, 2019 must have devices in place at the time of construction, while buildings that were under construction as of that date had until December 31, 2019 (or completion of construction, whichever came first). Lodging establishments that already existed before January 1, 2019 were required to have devices installed by December 31, 2020.

Operators of lodging establishments in Delaware should be aware that 16 Del. C. ch. 66C § 6604C set distinct installation deadlines based on a property's construction status relative to January 1, 2019. Compliant operators of pre-existing facilities ensured carbon monoxide detection devices were installed by the December 31, 2020 deadline, while those overseeing new construction incorporated devices at the build stage. Reviewing current installation records against these benchmarks is a standard part of maintaining compliance with Delaware's lodging safety requirements.

Guests and residents of Delaware lodging establishments are protected under 16 Del. C. ch. 66C § 6604C, which required carbon monoxide detection devices to be installed according to specific deadlines that have now passed for all categories of lodging establishments. If a lodging establishment appears to lack required carbon monoxide detectors, this provision may be relevant to any safety concern or complaint. Tenants and guests can explore reporting concerns to the appropriate Delaware state or local authority, or consult a tenant-rights organization for guidance on available options.
