16 Del. C. §§ 2201A, 2206A, 2212A § 2206A
Certified recovery housing admission agreements; termination
Operative Text
(a) A certified recovery house’s admission agreement must include the house’s termination and relapse policies. (b) An individual must agree to the terms of a certified recovery house’s admission agreement and sign the agreement before residing there. (c) Except if a resident refuses, whenever a certified recovery house terminates the resident’s admission agreement, the house shall make a reasonable effort to connect the resident with appropriate services.
Under 16 Del. C. §§ 2201A, 2206A, and 2212A, certified recovery houses in Delaware are required to include their termination and relapse policies within their admission agreements. No individual may begin residing at such a facility without first reading and signing that agreement. When a certified recovery house ends a resident's agreement, the house must make a reasonable effort to connect that person with appropriate services, unless the resident declines that assistance.

Operators of certified recovery houses under 16 Del. C. §§ 2201A, 2206A, and 2212A generally ensure that their written admission agreements explicitly set out both termination and relapse policies before any prospective resident moves in. Compliant operators obtain a signed copy of the agreement from each resident prior to occupancy and retain documentation of that signature. When a resident's agreement is terminated, operators typically document their efforts to connect the departing resident with appropriate services, unless the resident has refused such assistance.

Under 16 Del. C. §§ 2201A, 2206A, and 2212A, residents of certified recovery houses in Delaware have the right to review a written admission agreement—including the house's termination and relapse policies—before signing or moving in. If a certified recovery house ends your agreement, the facility is generally obligated to try to connect you with appropriate services unless you decline. Individuals who believe a certified recovery house has not followed these requirements may consider reaching out to Delaware's Division of Substance Abuse and Mental Health or a local tenant-rights or recovery-advocacy organization for information about available options.
