Under 1 Del. Admin. Code 703 § 4.6.2, in non-transient rental housing — including apartments, rental condominiums, and one- and two-family rental properties — this rule establishes a two-part responsibility around household fire warning equipment. Landlords must supply tenants with written or other informational materials covering how the equipment works, how it should be tested, how often testing should occur, and how it should be maintained. Tenants, in turn, are required to actually carry out the testing of that equipment in line with the standards set by NFPA 72, the National Fire Code, as incorporated into Delaware's regulations.

For Property Managers

Property owners and managers covered by 1 Del. Admin. Code 703 § 4.6.2 generally document and deliver to each tenant clear information about the fire warning equipment installed in the unit — specifically covering its operation, the correct testing method, the required testing frequency, and proper maintenance practices. Compliant operators typically provide this information at or before move-in and retain records showing it was delivered. Because the tenant's testing obligation flows from the information the landlord provides, ensuring that information is accurate and complete is a standard part of lease administration under this provision.

For Tenants

Under 1 Del. Admin. Code 703 § 4.6.2, tenants in non-transient rental housing have a right to receive from their landlord clear information about how to operate, test, and maintain the fire warning equipment in their home. Tenants are also responsible for testing that equipment according to the NFPA 72 standards referenced in the regulation. If a landlord fails to provide the required information, tenants may consider contacting Delaware's State Fire Marshal's office or a local tenant-rights organization to understand what options are available.
