Plain English

Section 9.0 of 1 Del. Admin. Code 202 establishes how time periods are counted under these administrative rules. When a triggering event occurs, the count begins on the day after that event, not on the event day itself. The final day of any calculated period is counted and included in the total.

For Property Managers

Under 1 Del. Admin. Code 202 § 9.0, property owners and managers calculating deadlines for responses, notices, or filings should begin counting the day after the relevant triggering event occurs. The last day of the period counts as a full, valid day, meaning a deadline falling on that day is generally considered timely. Compliant operators typically track these periods carefully to ensure submissions and notices are not inadvertently late.

For Tenants

1 Del. Admin. Code 202 § 9.0 governs how time periods are measured in proceedings under these rules, which can affect deadlines for responses, appeals, or other filings that may be relevant to a tenant's situation. Because the count starts the day after a triggering event and includes the final day, understanding this calculation can matter when evaluating whether a notice or action was timely. Tenants who have questions about specific deadlines in their proceedings may wish to consult a tenant-rights organization or legal aid resource familiar with Delaware administrative procedures.
