Cal. Civ. Code § 8-37ee-903
Selection from waitlist
Operative Text
(a) When a housing opportunity becomes available, the entity shall select the next applicant from the waitlist based on the occupant guideline, set forth in section 8-37ee-902 of the Regulations of Connecticut State Agencies, applicable preferences, if any, income-targeting policies and requirements, and screening policies applied by the entity. The entity shall select the first applicant on the waitlist for the appropriate housing opportunity and make a determination of eligibility and suitability for tenancy based on the applicant screening provisions contained in section 8-37ee-909 of the Regulations of Connecticut State Agencies. (b) The entity shall select an applicant from the waitlist at least thirty (30) days before a housing opportunity is available to prevent vacancies.
Conn. Agencies Regs. § 8-37ee § 8-37ee-903 establishes how housing entities must fill vacancies from a waitlist. When a unit becomes available, the entity must choose the next eligible applicant in order, applying occupancy guidelines, any applicable preferences, income-targeting requirements, and screening criteria. To avoid gaps in occupancy, the entity is required to begin the selection process at least 30 days before the unit is expected to become available.

Under Conn. Agencies Regs. § 8-37ee § 8-37ee-903, compliant housing operators maintain an active process for monitoring anticipated vacancies and initiating waitlist selection no fewer than 30 days in advance. Operators work through the waitlist in order, applying the occupancy guidelines from § 8-37ee-902, any stated preferences, income-targeting policies, and the applicant screening criteria found in § 8-37ee-909. Documenting each step of the selection process—including the order of consideration and the basis for eligibility and suitability determinations—supports consistent compliance with this provision.

Conn. Agencies Regs. § 8-37ee § 8-37ee-903 gives waitlisted applicants a right to be considered in proper order when a housing opportunity opens up, with the entity required to apply stated preferences and income-targeting rules fairly. If an applicant believes they were skipped over or that the 30-day advance selection requirement was not followed, they may raise that concern with the housing entity directly or contact a Connecticut tenant-rights organization for guidance. Applicants who believe the selection process was mishandled may also explore filing a complaint with the relevant state or local housing authority overseeing the program.
