Cal. Civ. Code § 17b-812-7
Eligible housing
Operative Text
(a) Dwelling units contracted for under the rental assistance program shall meet the definition of eligible housing provided in section 17b-812-1 of the Regulations of Connecticut State Agencies. (b) A family with a rental assistance certificate is responsible for finding a dwelling unit within the state that suits the needs of the family. A family may select the dwelling unit that it already occupies if the dwelling unit meets the department's occupancy policy and the provisions of section 17b-812-8 of the Regulations of Connecticut State Agencies. (c) The owner of the dwelling unit shall not reside in the same dwelling unit for which a rental assistance payment is being paid to the owner. (Effective March 21, 1996; Amended February 9, 2000; Amended May 31, 2007; Amended December 28, 2012)
Conn. Agencies Regs. § 17b-812-7 establishes the eligibility rules for housing units used under Connecticut's rental assistance program. Any dwelling unit contracted under the program must meet the state's definition of eligible housing, and the unit's owner is prohibited from living in the same unit for which rental assistance payments are being made. Families holding a rental assistance certificate bear the responsibility of locating a qualifying unit within Connecticut, though they may remain in their current home if it satisfies the department's occupancy policy and the requirements of § 17b-812-8.

Under Conn. Agencies Regs. § 17b-812-7, property owners who participate in Connecticut's rental assistance program are generally expected to ensure their units meet the eligible housing definition set out in § 17b-812-1 and comply with the department's occupancy standards. A critical compliance requirement is that the owner must not personally reside in the same dwelling unit for which a rental assistance payment is being received. Operators who manage multiple units should confirm that each unit contracted under the program is evaluated independently against these eligibility criteria.

Conn. Agencies Regs. § 17b-812-7 places the responsibility for finding a suitable, program-eligible dwelling unit within Connecticut on the family holding a rental assistance certificate. Families are permitted to stay in their current unit if it meets the department's occupancy policy and the standards described in § 17b-812-8, which can provide continuity during the assistance process. Tenants who have questions about whether a unit qualifies, or who believe a landlord may be improperly residing in an assisted unit, may consider contacting the Connecticut Department of Social Services or a local tenant-rights organization for general guidance.
