Plain English

Conn. Gen. Stat. § 8-116a sets out several rules governing elderly housing programs in Connecticut. Elderly residents may live alone in individual dwelling units without needing to form a family household, and the physical design of such housing must meet standards set by the Commissioner of Housing to address age-related needs. The provision also establishes requirements for income and asset limits, public waiting lists with dated receipts, and a criminal penalty—up to a $500 fine or six months' imprisonment, or both—for anyone who submits false income information on an application.

For Property Managers

Operators of elderly housing projects covered by Conn. Gen. Stat. § 8-116a must ensure their properties conform to the Commissioner of Housing's design standards for elderly residents and must work with the Commissioner to set approved maximum income and asset limits for admission. They are also required to issue dated, timed receipts to every applicant and to maintain a publicly accessible waiting list in the format prescribed by the Commissioner's regulations. Submitting or facilitating false income statements in connection with applications exposes individuals to criminal penalties under this provision.

For Tenants

Under Conn. Gen. Stat. § 8-116a, elderly applicants have the right to receive a written receipt showing the time and date of their application, and the waiting list itself is a public record that applicants may request to review. Elderly individuals living alone are explicitly eligible for these housing programs without needing to qualify as part of a family unit. Those who believe an operator is not following the waiting-list, design, or income-limit requirements of this provision may consider contacting the Connecticut Department of Housing or a local tenant-rights organization to understand available options.
