Plain English

Colorado Revised Statute § 38-12-216 establishes a voluntary mediation pathway for disputes between mobile home park management and homeowners that arise under Part 2 of the mobile home park statutes. Mediation is not available in cases involving unpaid rent or imminent health and safety threats to other residents. If the parties reach an agreement through mediation, it is submitted to the court as a stipulation, and either party may seek immediate court relief if the other later violates that stipulation.

For Property Managers

Under Colo. Rev. Stat. § 38-12-216, park management has the option to propose or agree to mediation before filing a forcible entry and detainer lawsuit, as long as the dispute does not involve nonpayment of rent or an imminent health or safety danger to other residents. Operators who participate in mediation and reach a stipulated agreement generally document that agreement carefully, since it becomes a court-enforceable stipulation. If a homeowner later fails to comply with the stipulation, management may apply directly to the court for relief without restarting the dispute process from scratch.

For Tenants

Colo. Rev. Stat. § 38-12-216 gives mobile home park residents the right to propose mediation—or agree to it when management proposes it—before a forcible entry and detainer lawsuit is filed, in disputes other than nonpayment of rent or imminent safety emergencies. Importantly, either party can exit the mediation process at any time without prejudice, meaning participation alone does not waive any legal rights. If a mediated agreement is reached and management later violates the resulting court stipulation, a homeowner may apply immediately to the court for relief; tenant-rights organizations familiar with Colorado mobile home park law can help residents understand what options are generally available under this provision.
