Cal. Civ. Code § 38-12-210
Closed parks prohibited.
Operative Text
(1) Neither the owner of a mobile home park nor the owner's agent may require as a condition of tenancy in a mobile home park that a prospective home owner has purchased a mobile home from any particular seller or from any one of a particular group of sellers. (2) Such owner or agent shall not give any special preference in renting to a prospective home owner who has purchased a mobile home from a particular seller. (3) A seller of mobile homes shall not require as a condition of sale that a purchaser locate in a particular mobile home park or in any one of a particular group of mobile home parks. (4) The owner or operator of a mobile home park shall treat all persons equally in renting or leasing available space. Notwithstanding the foregoing, nothing in this subsection (4) shall be construed to preclude owners and operators of mobile home parks from providing housing for older persons as defined in section 24-34-502 (7)(b), C.R.S.
Colorado Revised Statutes § 38-12-210 prohibits 'closed park' arrangements in which mobile home park owners, their agents, or mobile home sellers use purchasing or placement conditions to steer residents toward specific sellers or parks. A park owner cannot make tenancy contingent on where a prospective resident bought their home, and cannot give preferential treatment to those who bought from a favored seller. Conversely, a mobile home seller cannot require buyers to locate in a particular park or group of parks. Park owners and operators must treat all prospective residents equally when renting or leasing space, with a narrow exception for communities that qualify as housing for older persons under Colorado law.
Plain English — not legal advice.
Under § 38-12-210, compliant mobile home park operators do not condition tenancy on where an applicant purchased their home, and they do not give any renting preference to applicants who bought from a particular seller or group of sellers. Operators apply the same rental criteria to all prospective residents and document that process consistently to demonstrate equal treatment. Parks that wish to operate as housing for older persons as defined in C.R.S. § 24-34-502(7)(b) may do so, but that is the only recognized exception to the equal-treatment requirement in this provision.

Section 38-12-210 gives prospective and current mobile home park residents the right to be evaluated for tenancy without regard to where they purchased their home, and protects them from being steered toward a particular seller as a condition of renting space. If a park owner, manager, or mobile home seller appears to be imposing such conditions, that conduct may constitute a violation of this provision. Residents who believe their rights under § 38-12-210 have been violated can document the relevant communications, reach out to a tenant-rights organization familiar with Colorado mobile home park law, or explore whether a complaint to a state agency or civil court action is appropriate.
