Cal. Civ. Code § 38-12-1110
Mobile home park act dispute resolution and enforcement program fund.
Operative Text
(1) There is created in the state treasury the mobile home park act dispute resolution and enforcement program fund. All money collected pursuant to the program must be deposited in the fund. The fund shall be used by the division for the costs associated with administering the program. Subject to annual appropriation by the general assembly, the division may expend money from the fund to administer the program. All interest and income derived from the investment and deposit of money in the fund shall be credited to the fund. Any unexpended and unencumbered money remaining in the fund at the end of a fiscal year shall remain in the fund and shall not be credited or transferred to the general fund or another fund. (2) The division, by rule or as otherwise provided by law, may reduce the amount of any fee imposed under this part 11 if necessary pursuant to section 24-75-402 (3) to reduce the uncommitted reserves of the fund to which all or any portion of the fee is credited. After the uncommitted reserves of the fund are sufficiently reduced, the division, by rule or as otherwise provided by law, may increase the amount of the fees imposed under this part 11 as provided in section 24-75-402 (4). (3) (a) In fiscal year 2022-23 and each fiscal year thereafter, the general assembly shall appropriate money from the general fund to the mobile home park act dispute resolution and enforcement program fund for use by the division to conduct outreach, monitoring, and enforcement related to sections 38-12-217 and 38-12-203.5. (b) In fiscal year 2024-25 and each fiscal year thereafter, the general assembly may appropriate money from the general fund to the mobile home park act dispute resolution and enforcement program fund for use by the division to cover costs associated with complaints filed pursuant to section 38-12-1103 (2)(b) that are not covered by the fee authorized in section 38-12-1106 (8).
Colorado Revised Statutes § 38-12-1110 establishes a dedicated state fund—the Mobile Home Park Act Dispute Resolution and Enforcement Program Fund—to finance the administration of Colorado's mobile home park dispute resolution and enforcement program. Money collected through the program flows into this fund and stays there, with any unspent balances carrying over year to year rather than reverting to the general fund. The state legislature appropriates funds annually, and the administering division has authority to adjust program fees up or down to keep the fund's reserves at appropriate levels.
Plain English — not legal advice.
Under § 38-12-1110, the fees that mobile home park operators pay into the program are managed through this dedicated fund, and the division may adjust those fees by rule if reserves grow too large or fall too low. Compliant operators generally stay informed about any fee changes the division announces under this part 11, since adjustments can occur in either direction depending on the fund's uncommitted reserve levels. Keeping current with the division's rulemaking activity helps operators anticipate and budget for any changes to their program fee obligations.

Section § 38-12-1110 ensures that a stable, ring-fenced source of funding exists to support the state's mobile home park dispute resolution and enforcement program, including outreach and monitoring related to tenant protections under §§ 38-12-217 and 38-12-203.5. Starting in fiscal year 2022-23, the general assembly is required to appropriate money specifically for those enforcement and outreach activities, and beginning in 2024-25 it may also appropriate funds to cover complaint-processing costs not already covered by fees. Residents who believe their rights under the Mobile Home Park Act are being violated may find it useful to contact the administering division or a local tenant-rights organization to understand what complaint pathways are available under this program.
