Plain English

Under Colo. Rev. Stat. § 13-40-121, when a tenant deposits rent money with a court during a legal proceeding, that money does not automatically go to either party. Instead, the court controls when and how the deposited funds are released to the landlord, making its determination based on what is necessary to protect the rights of all parties involved.

For Property Managers

Colo. Rev. Stat. § 13-40-121 establishes that a landlord entitled to deposited rent must obtain a court order before those funds are released. Compliant operators generally monitor the status of any court proceeding in which rent has been deposited and work through proper legal channels to request disbursement. Understanding that the timing and manner of payment are entirely at the court's discretion helps landlords set realistic expectations about when deposited funds may become available.

For Tenants

Under Colo. Rev. Stat. § 13-40-121, rent money a tenant deposits with the court remains under judicial control and cannot be paid out to a landlord without a court order. This means tenants have a procedural protection ensuring that deposited funds are not disbursed until the court determines it is appropriate given the rights of all parties. Tenants involved in proceedings where rent has been deposited may wish to consult a tenant-rights organization or legal aid provider to understand how this process applies to their circumstances.
