(d) No person, firm, corporation, or association shall begin construction, alteration, repair, or extension of a mobile home or recreational vehicle park without first submitting and receiving approval from the department. (e) Detailed plans and specifications shall be submitted that include: (1) The park layout; (2) The sewage system; (3) The water source and distribution system; (4) All buildings; (5) Parking areas; (6) Dump stations; and (7) The topographical features of the park.
Under 20 Ark. Code R. pt. 138 § 138-102, any tract of land with three or more spaces used or intended for recreational vehicles, tiny houses on wheels, or mobile homes—where placement or maintenance services are provided for a fee—is classified as a mobile home or recreational vehicle park and must meet the state's regulatory standards. The owner or operator bears direct responsibility for maintaining that compliance. Before any construction, alteration, repair, or extension of such a park can begin, the Arkansas Department of Health must review and approve detailed plans covering the park layout, sewage, water systems, buildings, parking, dump stations, and topographical features.

Owners and operators of parks covered by 20 Ark. Code R. pt. 138 § 138-102 are generally responsible for ensuring their property meets all requirements set out in this part of the Arkansas code. Compliant operators typically submit comprehensive plans and specifications—including sewage, water distribution, and site layout details—to the Arkansas Department of Health and obtain written approval before breaking ground on any new construction, alteration, repair, or expansion. Operators who believe a specific requirement creates an undue hardship may submit a written request for a waiver or exception, which the Department of Health evaluates on a case-by-case basis at its discretion.

Residents of mobile home parks or recreational vehicle parks in Arkansas benefit from 20 Ark. Code R. pt. 138 § 138-102, which places the burden of regulatory compliance squarely on the park owner or operator rather than on individual occupants. If a park appears to be operating without proper Department of Health approval—for example, following unpermitted construction or expansion—tenants may have grounds to raise that non-compliance as a concern with the Arkansas Department of Health. Tenant-rights organizations and legal aid services can help residents understand what remedies or complaint processes may be available under this provision.
