20 CAR § 130-1004. Work practice standards. (a) No individual and/or contractor, consultant, or building owner of target housing or child-occupied facilities shall perform lead-based paint activities, or conduct a project resulting in the permanent elimination of lead-based paint, or conduct a project in response to a state, local, or federal lead-based paint order on target housing or child-occupied facilities without complying with the work practice standards set forth in this part as of July 1, 2011. (b) No homeowner shall perform lead-based paint activities, or conduct a project resulting in the permanent elimination of lead-based paint, or conduct a project in response to a state, local, or federal lead-based paint order on target housing or residential dwelling that is occupied by a person or persons other than the owner or the owner’s immediate family while the lead-based paint activities are being performed, or a child-occupied facility, or in which a child has been identified with elevated blood lead.
Section 130-1004 of the Arkansas lead-based paint regulations establishes work practice standards that apply whenever lead-based paint activities are carried out in target housing or child-occupied facilities. Under this provision, contractors, consultants, building owners, and homeowners are all prohibited from performing lead-based paint work—whether as part of routine activities, permanent elimination projects, or in response to a government order—unless they comply with the standards outlined in this part, effective July 1, 2011. Homeowners face an additional restriction: they may not perform such work themselves on properties occupied by anyone outside their immediate family, or in any home where a child has been identified with elevated blood lead levels.

Building owners and property managers subject to § 130-1004 are generally expected to ensure that any lead-based paint activities, elimination projects, or government-ordered remediation work on target housing or child-occupied facilities is carried out in strict compliance with the work practice standards established in this part. Compliant operators typically verify that all contractors and consultants they hire are following these standards before work begins, rather than assuming compliance after the fact. Owners who also occupy their property should be aware that the homeowner exemption under § 130-1004(b) does not apply when the property is occupied by anyone outside the owner's immediate family or when a child with elevated blood lead levels has been identified there.

Section 130-1004 is designed in part to protect occupants of target housing and child-occupied facilities by requiring that lead-based paint work meet established safety standards. Tenants who believe that a landlord or contractor is performing lead-based paint activities without following the work practice standards set out in this provision may have grounds to raise a violation with Arkansas's lead-based paint regulatory program or a relevant state or local agency. Tenant-rights organizations can help residents understand what protections apply to their situation and what general enforcement paths—such as filing a complaint or raising a violation as a defense—may be available under § 130-1004.
