15 Ark. Code of Rules § 93-113
Affordable rents
Operative Text
15 CAR § 93-113. Affordable rents. Rents for eligible tenants will be considered to be affordable if the rent does not exceed thirty percent (30%) of the household’s income at eighty percent (80%), sixty percent (60%), fifty percent (50%), and thirty percent (30%) of the United States Department of Housing and Urban Development area median income, adjusted for family size, for the area where the Arkansas Housing Trust Fund-assisted activity is located or is to be located.
Under 15 Ark. Code R. pt. 93 § 93-113, a rent is deemed affordable for eligible tenants when it does not exceed 30% of the household's income, calculated at specific income tiers — 80%, 60%, 50%, and 30% of the HUD area median income (AMI) — adjusted for family size and based on the geographic area where the Arkansas Housing Trust Fund-assisted activity is located. This rule establishes a ceiling on what can be charged to qualifying households at each income band, tying affordability directly to local median income benchmarks. The standard applies specifically to housing activities supported by the Arkansas Housing Trust Fund.

Operators of Arkansas Housing Trust Fund-assisted properties under 15 Ark. Code R. pt. 93 § 93-113 generally ensure that rents charged to eligible tenants do not surpass 30% of the applicable income limit for the relevant AMI tier — 80%, 60%, 50%, or 30% — adjusted for family size and the property's geographic area. Compliant operators typically obtain current HUD AMI figures for their area and recalculate maximum allowable rents whenever those figures are updated or when tenant household composition changes. Maintaining documentation of income determinations and rent calculations is a common practice for demonstrating compliance with this affordability standard.

Section 15 Ark. Code R. pt. 93 § 93-113 establishes that eligible tenants living in Arkansas Housing Trust Fund-assisted housing have a right to rents capped at 30% of the income limit corresponding to their household's AMI tier, adjusted for family size and location. If a tenant believes their rent exceeds this threshold, they may raise the issue as a potential violation with the administering agency or seek guidance from a local tenant-rights organization familiar with Arkansas Housing Trust Fund requirements. Tenants can also contact the U.S. Department of Housing and Urban Development for information about applicable area median income figures for their region.
