Ariz. Rev. Stat. § 33-1419
Inheritance of mobile home; requirements
Operative Text
For any person who inherits a mobile home by will, trust or any other testamentary conveyance, all of the following apply: 1. The person may do either of the following: (a) Reside in the mobile home on the premises only if the person meets the requirements prescribed for other tenants in the mobile home park, including compliance with age requirements, background checks and signing the mobile home park's standard rental documentation. (b) Sell the mobile home in accordance with the provisions of this article and the deceased tenant's rental agreement. 2. The person shall pay any amount past due to the landlord from the deceased tenant. 3. The landlord shall apply all of the deceased tenant's prepaid amounts or credits, including security deposits, for the benefit of the person inheriting the mobile home.
Under A.R.S. § 33-1419, when a person inherits a mobile home through a will, trust, or other testamentary transfer, they have two options: move into the home if they satisfy the park's standard tenant requirements (such as age restrictions, background checks, and signing a rental agreement), or sell the home according to the terms of the article and the deceased tenant's rental agreement. The inheritor is responsible for any rent or fees the deceased tenant left unpaid. At the same time, the landlord must apply any prepaid amounts or credits — including security deposits — that the deceased tenant had on account toward the benefit of the inheriting person.

Under A.R.S. § 33-1419, operators of mobile home parks generally apply their standard tenant-qualification process — including age verification, background screening, and execution of the park's rental documentation — to anyone seeking to reside in an inherited mobile home, treating that person the same as any prospective tenant. Landlords are required to apply any prepaid funds or security deposits held for the deceased tenant to the account of the inheriting person rather than retaining or forfeiting those amounts. Operators also document and collect any past-due balances owed by the deceased tenant from the inheriting person before or as part of establishing the new tenancy or facilitating a sale.

A.R.S. § 33-1419 gives a person who inherits a mobile home a clear choice: qualify under the park's standard tenant criteria and move in, or sell the home consistent with the article's provisions and the original rental agreement. If you inherit such a home, the law entitles you to have any security deposits or prepaid credits the deceased tenant held applied for your benefit — the landlord cannot simply keep those funds. If you believe a landlord is not honoring these protections, general enforcement paths include raising the provision as a defense in any eviction or collection proceeding, contacting an Arizona tenant-rights organization, or consulting with an attorney familiar with mobile home park law.
