Alaska Stat. § 34.05. § 34.05.100
Tenant responsibilities in premises not subject to AS 34.03
Operative Text
(a) In rented premises other than premises to which the provisions of AS 34.03 apply, the tenant may not knowingly engage at the premises in prostitution, an illegal activity involving a place of prostitution, an illegal activity involving alcoholic beverages, an illegal activity involving gambling or promoting gambling, an illegal activity involving a controlled substance, or an illegal activity involving an imitation controlled substance, or knowingly permit others in the premises to engage in one or more of those activities at the rental premises. (b) If there is noncompliance with (a) of this section, a person may seek relief under AS 09.50.170 — 09.50.240. (c) An order of abatement entered by a court under AS 09.50.210 against premises under this section terminates a rental agreement on the premises subject to the order of abatement. (d) In this section, (1) “illegal activity involving alcoholic beverages,” “illegal activity involving a controlled substance,” “illegal activity involving an imitation controlled substance,” “illegal activity involving gambling or promoting gambling,” “illegal activity involving a place of prostitution,” and “prostitution” have the meanings given in AS 34.03.360; (2) “premises” means a structure or the structure of which it is a part, and facilities and appurtenances in it, and grounds, areas, and facilities held out for the use of persons entitled to possession under an agreement that relates to its use.
Alaska Statute AS 34.05.100 applies to rental properties that fall outside the residential landlord-tenant protections of AS 34.03. Under this provision, tenants are prohibited from knowingly engaging in, or knowingly allowing others to engage in, a defined set of illegal activities on the rental premises — including prostitution, illegal gambling, and activities involving controlled substances or alcoholic beverages. When a court issues an abatement order under AS 09.50.210 in response to a violation, the rental agreement for the affected premises is automatically terminated.
Plain English — not legal advice.
Property owners and managers overseeing rentals not governed by AS 34.03 should be aware that AS 34.05.100 establishes clear conduct prohibitions for tenants on those premises. Compliant operators typically document any known or reported illegal activity and understand that a court-ordered abatement under AS 09.50.210 can terminate a rental agreement by operation of law. Familiarity with the relief mechanisms available under AS 09.50.170–09.50.240 helps operators understand the legal pathways available when prohibited conduct occurs.

Under AS 34.05.100, tenants in rental properties not covered by AS 34.03 are prohibited from knowingly participating in or permitting certain illegal activities — such as prostitution, illegal gambling, or controlled substance offenses — on the rental premises. A violation can expose a tenant to legal action under AS 09.50.170–09.50.240, and a court-issued abatement order can result in the termination of the rental agreement. Tenants who have questions about whether their rental is subject to AS 34.03 or AS 34.05.100, or who believe they are being wrongly accused of a violation, may benefit from consulting a tenant-rights organization or legal aid service familiar with Alaska housing law.
