Alaska Stat. § 34.03. § 34.03.030
Effect of unsigned or undelivered rental agreement
Operative Text
(a) If the landlord does not sign and deliver a written rental agreement signed and delivered to the landlord by the tenant, acceptance of rent without reservation by the landlord gives the rental agreement the same effect as if it had been signed and delivered by the landlord. (b) If the tenant does not sign and deliver a written rental agreement signed and delivered to the tenant by the landlord, acceptance of possession and payment of rent without reservation gives the rental agreement the same effect as if it had been signed and delivered by the tenant. (c) If a rental agreement given effect by the operation of this section provides for a term longer than one year, it is effective only for one year.
Alaska Statute AS 34.03 § 34.03.030 addresses what happens when a written rental agreement is not formally signed and returned by one of the parties. If a landlord accepts rent without reservation after receiving a tenant-signed agreement, the agreement becomes legally binding as though the landlord had signed it. Conversely, if a tenant takes possession and pays rent without reservation after receiving a landlord-signed agreement, the agreement is treated as though the tenant had signed it. However, any agreement brought into effect this way is capped at a one-year term, even if the written document specifies a longer period.
Plain English — not legal advice.
Under AS 34.03 § 34.03.030, property owners and managers should be aware that accepting rent payments without reservation can legally bind them to the terms of a written agreement they never formally signed. Compliant operators typically review and formally execute rental agreements before collecting any rent, ensuring there is no ambiguity about which terms govern the tenancy. Keeping clear records of signed agreements and the dates rent is first accepted helps avoid unintended contractual obligations.

AS 34.03 § 34.03.030 provides tenants with important protections when a landlord fails to countersign a written rental agreement. If a landlord accepts rent without reservation, the unsigned agreement may still be enforceable against the landlord, giving tenants a basis to assert the agreed-upon terms. Tenants who believe a landlord is disregarding terms of an agreement brought into effect under this provision may consider raising the statute as a defense in any dispute, consulting a tenant-rights organization, or seeking guidance from a local legal aid office.
