Alaska Stat. § 18.55. § 18.55.130
Qualifications of tenants
Operative Text
(a) In the operation or management of housing for low-income households, the corporation shall, from time to time, establish rents and requirements for admission of tenants to its housing in each municipality in which the housing of the corporation is located. (b) Except in the case of leased housing as provided in 42 U.S.C. 1437f, the corporation shall fix the income limits for occupancy in its housing for low-income households after taking into consideration (1) the family size, composition, age, physical disabilities, and other factors that might affect the rent-paying ability of the family; and (2) the economic factors that affect the financial stability and solvency of the project. (c) [Repealed, § 18 ch 7 SLA 2011.] (d) [Repealed, § 18 ch 7 SLA 2011.] (e) Nothing in this section or AS 18.55.120 limits the power of the corporation to vest in an obligee the right to take possession of a housing project or have a receiver appointed free from the restrictions imposed by this section or AS 18.55.120 in case of default by the corporation.
Alaska Statute AS 18.55.130 governs how the Alaska Housing Finance Corporation (the "corporation") sets tenant qualifications and rent levels for its low-income housing programs. The corporation is required to periodically establish both rent schedules and admission requirements tailored to each municipality where it operates housing. When setting income limits for occupancy, the corporation must weigh factors such as family size, age, physical disabilities, and the financial health of the housing project itself, with an exception for federally leased housing under 42 U.S.C. 1437f.

Operators and managers working under the Alaska Housing Finance Corporation's low-income housing programs should be aware that AS 18.55.130 places the authority to set rents and admission criteria with the corporation itself, not individual property managers. Compliant operators generally follow the income limits and tenant qualification standards the corporation establishes for the specific municipality where the housing is located. Managers should also note that the corporation retains the ability, under subsection (e), to grant an obligee the right to take possession or have a receiver appointed in the event of a default, which can affect management continuity.

Under AS 18.55.130, tenants and applicants for Alaska Housing Finance Corporation low-income housing have a right to have their admission evaluated under criteria that account for family size, composition, age, and physical disabilities, not just raw income figures. If an applicant believes the corporation has not properly applied these factors in a denial or rent determination, general enforcement paths include filing a complaint or inquiry directly with the Alaska Housing Finance Corporation or consulting a tenant-rights organization familiar with Alaska public housing rules. Federally assisted leased housing under 42 U.S.C. 1437f operates under a separate framework, so tenants in those units may have additional or different avenues available through federal housing programs.
