Alaska Admin. Code tit. 6, § 30. § 6.30.840
Retention of records
Operative Text
(a) The records specified in 6 AAC 30.810 - 6 AAC 30.830 must be maintained for inspection and copying by the commission for at least two years after the record is made. (b) In addition to the requirement in (a) of this section, a respondent must maintain the records of a person who has filed a complaint with the commission, or records of a class of persons named in a complaint filed with the commission, and the records of persons or classes in similar or related circumstances until final disposition of the complaint by the commission.
Under 6 AAC 30.840, housing-related records described in 6 AAC 30.810 through 6 AAC 30.830 must be kept available for commission inspection and copying for a minimum of two years from the date each record is created. Beyond that baseline, if a complaint is filed with the commission, records tied to the complainant, any named class of persons, or individuals in similar or related circumstances must be preserved until the commission fully resolves the complaint. This rule establishes both a standard retention floor and an extended hold triggered by active complaint proceedings.
Plain English — not legal advice.
Operators subject to 6 AAC 30.840 generally maintain organized recordkeeping systems that preserve the documents identified in 6 AAC 30.810–6 AAC 30.830 for no less than two years. When a complaint is filed with the commission—whether naming an individual tenant or a class of tenants—compliant operators extend retention of all related records, including those of persons in similar or related circumstances, until the commission issues a final disposition. Establishing a clear internal protocol for flagging records subject to complaint-related holds helps ensure compliance with both the standard and extended retention requirements of 6 AAC 30.840.

Under 6 AAC 30.840, a respondent is required to preserve records connected to a complaint you or others in similar circumstances have filed with the commission, and that obligation lasts until the commission reaches a final resolution. This means relevant records cannot simply be discarded or destroyed once a complaint is active. Tenants who believe records are being improperly withheld or destroyed may raise that concern directly with the commission or consult a tenant-rights organization familiar with Alaska housing regulations.
