Ala. Code §§ 35-12A-1 to 35-12A-15 § 35-12A-3
Notice to Tenant.
Operative Text
Prior to selling the tenant’s manufactured dwelling pursuant to this chapter, the manufactured dwelling community owner shall provide a written notice to the tenant by one of the following methods: (1) Personal delivery to the tenant of the manufactured dwelling. (2) Certified mail addressed and mailed to the tenant at the last known mailing address known to the manufactured dwelling community owner. (3) Affixing a notice on the doors of the dwelling.
Under Alabama Code § 35-12A-3, before a manufactured dwelling community owner may sell a tenant's manufactured dwelling, the owner must first deliver a written notice to the tenant. That notice must reach the tenant through one of three specified channels: personal delivery, certified mail to the tenant's last known address, or posting the notice on the dwelling's door. The rule establishes a mandatory procedural step that must occur before any sale can proceed.
Plain English — not legal advice.
Alabama Code § 35-12A-3 requires manufactured dwelling community owners to complete a formal written-notice step before moving forward with any sale of a tenant's dwelling. Compliant operators typically document which delivery method was used—whether personal delivery, certified mail with tracking records, or door posting—and retain that documentation as proof of compliance. Maintaining accurate, up-to-date tenant mailing addresses supports the certified-mail option and reduces the risk of a procedural challenge to the sale.

Alabama Code § 35-12A-3 gives tenants the right to receive written notice before their manufactured dwelling is sold by the community owner. If a tenant believes proper notice was not delivered through one of the three required methods—personal delivery, certified mail, or door posting—that procedural gap may be relevant to the validity of the sale. Tenants who have questions about whether proper notice was given can consult a tenant-rights organization or a licensed attorney familiar with Alabama manufactured housing law.
