Section 24-8-3 of the Alabama Fair Housing Act establishes the foundational vocabulary used throughout Ala. Code §§ 24-8-1 to 24-8-15. It defines key terms such as "dwelling," "handicap," "familial status," and "covered multifamily dwellings" that determine the scope of who and what is protected under the chapter. The definitions also identify ADECA (the Alabama Department of Economic and Community Affairs) as the administering office and clarify which types of housing qualify for older-persons exemptions. These definitions shape how every other provision in the chapter is interpreted and applied.
Plain English — not legal advice.
Property owners and managers operating under Ala. Code §§ 24-8-1 to 24-8-15 should be familiar with the definitions in § 24-8-3, as they determine which properties and residents fall within the law's reach. For example, "covered multifamily dwellings" specifically includes buildings of four or more units with elevators and ground-floor units in similar buildings, which affects accessibility obligations. Operators of housing marketed to older adults should pay close attention to the "housing for older persons" definition, including the 80-percent occupancy threshold and the requirement that ADECA-developed regulations be followed to qualify for that designation.

Section 24-8-3 sets out the definitions that determine whether a person or property is covered by Alabama's fair housing protections under §§ 24-8-1 to 24-8-15. Tenants should be aware that "familial status" protections extend to households with children under 18, pregnant individuals, and those in the process of obtaining legal custody, while "handicap" covers a broad range of physical and mental impairments. Those who believe a landlord's actions may constitute a "discriminatory housing practice" as defined in this section can explore options such as filing a complaint with ADECA or consulting a tenant-rights organization for guidance on available remedies.
