Importantly, each individual home involved in a violation is treated as a separate, distinct offense, meaning penalties can multiply across multiple properties.

For Property Managers

Ala. Admin. Code r. 535-X-10 § 535-X-10-.08 establishes that operators who fail to comply with the underlying rule's requirements risk misdemeanor charges carrying fines up to $1,000 and potential jail time per incident. Because each home involved constitutes its own separate violation, property managers overseeing multiple units generally ensure that every individual property meets the rule's standards independently. Compliant operators typically maintain thorough documentation of certification, inspection, and standards compliance for each home in their portfolio.

For Tenants

Ala. Admin. Code r. 535-X-10 § 535-X-10-.08 signals that the state treats violations of this rule seriously enough to impose criminal misdemeanor penalties on those responsible. Tenants who believe a landlord or housing provider is operating in violation of this rule may consider reporting concerns to the appropriate Alabama state authority or consulting a tenant-rights organization familiar with Alabama housing regulations. Because each home is counted as a separate violation under this provision, non-compliance affecting multiple residents may carry compounded consequences for the responsible party.
