SUBJECT: Extension of Mandatory Compliance Date: Sections 102 and 104 of the Housing
Opportunity Through Modernization Act of 2016 (HOTMA)
I. Purpose
The purpose of this Notice is to extend the HOTMA final rule compliance date to January 1,
2026. This Notice supersedes Notice H 2024–09, which extended the date by which Owners
must comply fully with Sections 102 and 104 of the Housing Opportunity Through
Modernization Act of 2016 (HOTMA) final rule until July 1, 2025.
II. Background
Section 6.2 of Notice H 2023–10 requires Multifamily Housing Owners to be in full
compliance with the HOTMA final rule and HUD’s updated income and asset
documentation requirements for income certifications having an effective date on or after
January 1, 2025. Thereafter, HUD published Notice H 2024–09 that extended the January 1,
2025 deadline to July 1, 2025. This Notice however extends the compliance date to January
1, 2026. The requirement applies to Owners participating in the programs listed in section 4
(Applicability) of Notice H 2023–10.
III. Revision of Date
The compliance dates stated in section 6.2 of Notice H 2023–10 and Notice H 2024–09 are
extended to January 1, 2026.

Housing Notice § 2025-03 extends the deadline by which multifamily housing owners participating in certain HUD programs must be in full compliance with Sections 102 and 104 of the Housing Opportunity Through Modernization Act of 2016 (HOTMA). The new mandatory compliance date is January 1, 2026, replacing the prior deadline of July 1, 2025 that had been set by Notice H 2024-09. This extension applies specifically to income certifications and updated income and asset documentation requirements under the HOTMA final rule.
Plain English — not legal advice.
Under Housing Notice § 2025-03, multifamily project owners participating in the applicable HUD programs now have until January 1, 2026 to achieve full compliance with the HOTMA final rule's income and asset documentation requirements for income certifications. Compliant operators generally review their certification processes, staff training, and software systems well in advance of the new deadline to ensure all income certifications with effective dates on or after January 1, 2026 meet the updated standards. Questions about implementation can be directed to HUD at MFH_HOTMA@hud.gov, as identified in the Notice.

Housing Notice § 2025-03 affects how and when the housing owners of HUD-assisted multifamily properties must apply updated income and asset verification rules under HOTMA when processing income certifications. Tenants in these properties may notice changes to the documentation requested during annual or interim recertifications once the January 1, 2026 compliance date takes effect. Tenants who have concerns about how their income or assets are being calculated or documented can reach out to a local tenant-rights organization or contact HUD directly for general program information.
