24 C.F.R. § 92.350
§ 92.350 Other Federal requirements and nondiscrimination. (24 CFR Part 92)
Operative Text
(a) The Federal requirements set forth in 24 CFR part 5, subpart A, are applicable to participants in the HOME program. The requirements of this subpart include: nondiscrimination and equal opportunity; disclosure requirements; debarred, suspended or ineligible contractors; drug-free work; and housing counseling. (b) The nondiscrimination requirements at section 282 of the Act are applicable. These requirements are waived in connection with the use of HOME funds on lands set aside under the Hawaiian Homes Commission Act, 1920 (42 Stat. 108).
Under § 92.350, participants in the HOME Program are subject to a set of overarching federal requirements drawn from 24 CFR Part 5, Subpart A, covering areas such as nondiscrimination, equal opportunity, contractor eligibility, drug-free workplace standards, and housing counseling obligations. Additionally, the nondiscrimination provisions found in section 282 of the HOME statute apply to the program. A limited exception exists: those nondiscrimination requirements are waived when HOME funds are used on lands designated under the Hawaiian Homes Commission Act of 1920.
Plain English — not legal advice.
Property owners and managers participating in the HOME Program under § 92.350 are generally expected to operate in full compliance with the federal requirements incorporated by reference from 24 CFR Part 5, Subpart A, including maintaining nondiscriminatory practices in tenant selection, ensuring contractors are not debarred or suspended, and adhering to drug-free workplace standards. Compliant operators typically keep documentation demonstrating adherence to equal opportunity requirements and any applicable housing counseling obligations. Those working with HOME-assisted properties on Hawaiian Home Lands should be aware that the standard nondiscrimination waiver under § 92.350(b) may affect how certain requirements apply in that specific context.

Tenants living in housing assisted through the HOME Program have protections under § 92.350, including rights tied to nondiscrimination and equal opportunity as established in both 24 CFR Part 5, Subpart A, and section 282 of the HOME statute. If a tenant believes these protections have been violated, general enforcement paths can include filing a complaint with HUD, raising the violation through a local participating jurisdiction's grievance process, or reaching out to a tenant-rights organization familiar with federally assisted housing. Tenants on Hawaiian Home Lands should be aware that § 92.350(b) contains a specific waiver of certain nondiscrimination requirements in that context, which may affect available protections.
