24 C.F.R. § 884.122
§ 884.122 Separate project requirement. (24 CFR Part 884)
Operative Text
(a) In the case of a Private-Owner Project or a PHA-Owner Project, each Agreement and Contract shall constitute a separate project. (b) In the case of a Private-Owner/PHA Project such project may not include more than one type of Section 8 assistance, shall be processed with a separate ACC List and ACC Part I and shall be assigned a separate project number. All new construction units to be placed under a single Contract shall comprise a separate project. However, the field office director may designate as a single project the units to be covered by two or more such Contracts for new construction projects where: (1) The units are placed under ACC on the same date; and (2) Such consolidation is necessary in the interest of administrative efficiency.
Section 884.122 establishes how housing assistance projects under 24 CFR Part 884 must be organized and counted as distinct units for administrative purposes. For Private-Owner and PHA-Owner projects, each Agreement and Contract automatically forms its own separate project. For Private-Owner/PHA projects, the rule limits each project to a single type of Section 8 assistance, requires its own ACC documentation and project number, and generally treats new construction units under a single Contract as one project — though a field office director may consolidate multiple new construction Contracts into one project when they share the same ACC placement date and consolidation serves administrative efficiency.

Property owners and housing authorities operating under 24 CFR Part 884 § 884.122 generally maintain distinct project records, ACC documentation, and project numbers for each qualifying Agreement or Contract. Operators of Private-Owner/PHA projects take care not to mix types of Section 8 assistance within a single project and ensure each project is processed with its own ACC List and ACC Part I. When new construction Contracts are involved, compliant operators are aware that consolidation into a single project is only available through a field office director's designation and only when the specific conditions outlined in § 884.122(b) are met.

For tenants living in housing assisted under 24 CFR Part 884, § 884.122 governs how the underlying project structure is organized, which can affect which ACC and Contract governs their unit and what type of Section 8 assistance applies. If a tenant believes their unit has been improperly grouped with a different type of Section 8 assistance or that the project structure does not conform to this provision, they may raise this concern with their local HUD field office or a tenant-rights organization familiar with federal housing programs. Tenants can also consult HUD's publicly available ACC and project records to better understand how their housing assistance is structured under § 884.122.
