Section 58-7 of the Yonkers City Code designates certain serious housing violations as 'enhanced Class II offenses,' carrying both criminal and civil consequences. On the criminal side, a violation can result in a fine between $200 and $1,000, up to 15 days of imprisonment, or both. On the civil side, penalties range from $500 to $7,500. The specific conduct covered includes inhabiting or allowing habitation of a condemned unit, failing to provide heat or hot water, failing to maintain required utility services, and failing to operate or maintain a valid boiler permit under § 58-23.
Plain English — not legal advice.
Under § 58-7 of the Yonkers City Code, operators who allow condemned units to be occupied, fail to supply heat or hot water, let required utility services lapse, or neglect boiler permit obligations expose themselves to enhanced Class II offense classification. Compliant property managers keep boiler permits current under § 58-23, maintain uninterrupted utility services, and ensure no condemned unit is occupied. Because this provision carries both criminal fines of up to $1,000 and civil penalties up to $7,500, proactive maintenance and permit management are central to lawful operation in Yonkers.

Section 58-7 of the Yonkers City Code gives tenants a legal framework when a landlord fails to provide heat, hot water, or required utility services, or when a unit has been condemned but remains occupied. These failures are classified as enhanced Class II offenses, meaning the city can pursue both criminal and civil penalties against a non-compliant landlord. Tenants who believe one of these conditions exists may consider contacting the City of Yonkers code enforcement office, documenting the conditions thoroughly, or reaching out to a local tenant-rights organization to understand available options.
