White Plains, N.Y., Mun. Code ch. 4-29 § 4-29-12
If an owner that has a valid license elects to vacate a building, he/she shall notify the Department of Building immediately. The license for the building will remain in effect for the duration of the licensing period. The owner is not required to perform interior self-inspections while the building is vacant, however, it is the owner's responsibility to turn off gas at the street, secure all doors and windows and maintain exterior areas of the building/property in accordance with the New York State Property Maintenance Code and the White Plains Supplemental Building Code. Periodic inspections (at a minimum of once per month) of the property are required to ensure that the building remains secure. Re-occupancy and rental of the building after the license period has expired will require a new application.

Plain English

Under White Plains Mun. Code ch. 4-29 § 4-29-12, when a licensed building is voluntarily vacated, the owner must promptly notify the Department of Building and take specific steps to secure the property—including shutting off gas at the street and securing all openings—while maintaining exterior areas in compliance with applicable property maintenance codes. The existing license continues through its current period, but interior self-inspections are not required during the vacancy. Once the license period expires, re-occupancy or re-rental triggers a new application requirement.

For Property Managers

Operators subject to White Plains Mun. Code ch. 4-29 § 4-29-12 who choose to vacate a licensed building generally notify the Department of Building immediately upon that decision. Compliant owners document their monthly perimeter inspections, confirm gas shutoff at the street, and keep all doors, windows, and exterior areas in good order per the New York State Property Maintenance Code and the White Plains Supplemental Building Code. When the licensing period ends, owners planning to re-rent or re-occupy the building submit a new license application before resuming occupancy.

For Tenants

White Plains Mun. Code ch. 4-29 § 4-29-12 establishes obligations that apply to building owners when a property is vacated, including securing the structure and maintaining the exterior throughout the vacancy period. Prospective tenants considering a previously vacant building may want to confirm that the owner has obtained a current, valid license before re-occupancy, since the provision requires a new application once the prior license period has expired. Tenant-rights organizations or the White Plains Department of Building can be consulted for information about whether a building's licensing status is in order.
