Watervliet, N.Y., Code of Ordinances ch. 175 § 175-9
Responsibilities of lodging house operators
Operative Text
Lodging house operators shall be responsible for compliance with this chapter in regard to the following: A. Limiting occupancy to the maximum permitted by this chapter. B. Maintenance of safe and sanitary conditions in all parts of the lodging house premises. C. Maintenance and operation of all required service facilities. D. Maintenance of all plumbing, cooking and refrigeration fixtures and appliances within his control as well as other building equipment and facilities, in an operative, clean and sanitary condition. E. Sanitary maintenance of walls, floors, and ceilings. F. Keeping exits clear and unencumbered. G. Disposal of building garbage and refuse in a clean and sanitary manner. H. Extermination of insects, rodents or other pests on the premises. I. Hanging and removing required screens. J. Changing of linens weekly and upon change in occupancy.
Section 175-9 of Watervliet's Code of Ordinances, Chapter 175, establishes a comprehensive list of operational duties that fall squarely on lodging house operators rather than on tenants or guests. These duties cover everything from capping occupancy at permitted levels to maintaining plumbing, cooking, and refrigeration equipment, keeping exits clear, controlling pests, and changing linens on a weekly basis and whenever a new occupant moves in. The provision makes the operator the responsible party for the overall safe and sanitary condition of the entire lodging house premises.
Plain English — not legal advice.
Under § 175-9 of Watervliet Code Chapter 175, compliant lodging house operators generally track and enforce the maximum occupancy limits set by the chapter, conduct regular inspections of plumbing, cooking, and refrigeration fixtures, and ensure all service facilities remain operational. Operators also maintain a documented schedule for linen changes—weekly and at each change of occupancy—and keep a pest-control program in place to address insects, rodents, and other pests. Keeping exits clear, disposing of garbage and refuse properly, and maintaining walls, floors, and ceilings in a sanitary condition are likewise standard practices for operators seeking to meet the requirements of this section.

Section 175-9 of Watervliet Code Chapter 175 places the burden of maintaining safe, sanitary, and properly equipped lodging house premises on the operator, not the occupant. If conditions such as pest infestations, blocked exits, broken plumbing or refrigeration equipment, or failure to change linens are present, those may constitute violations of the operator's duties under this provision. Occupants who believe these standards are not being met can document the conditions, contact the appropriate local code enforcement or housing authority in Watervliet, or reach out to a tenant-rights organization to understand what options may be available.
