Watervliet, N.Y., Code of Ordinances ch. 175 § 175-6
Interpretation and effect
Operative Text
A. The provisions of this chapter shall supersede local laws, ordinances, codes or regulations to the extent that such laws, ordinances, codes or regulations are inconsistent with the provisions of this chapter, provided that nothing in this chapter shall be construed to prevent the adoption and enforcement of a law, ordinance, code or regulation which is more restrictive or establishes a higher standard than those provided in this ordinance, and such more restrictive requirement or higher standard shall govern during the period in which it is in effect. B. Where a provision of this chapter is found to be in conflict with a provision of a zoning, building, electrical, plumbing, fire safety, health, water supply or sewage disposal law, provision of this Code or other City ordinance or regulation adopted pursuant thereto or other local law, ordinance, code or regulation, the provision or requirement which is the more restrictive or which establishes the higher standard shall prevail.
Watervliet, N.Y., Code of Ordinances ch. 175 § 175-6 establishes a hierarchy for resolving conflicts between this chapter and other local laws or regulations. When another rule is more restrictive or sets a higher standard than this chapter, that stricter rule takes precedence. Conversely, this chapter overrides any conflicting local rules that are less restrictive than its own requirements.
Plain English — not legal advice.
Under § 175-6, property owners and managers operating in Watervliet must be aware that compliance with this chapter does not automatically satisfy every applicable local requirement. Where a zoning, building, fire safety, health, or other city ordinance imposes a stricter standard than ch. 175, that stricter standard is the operative one. Compliant operators generally review all overlapping local codes to identify whichever requirement is most demanding and apply that standard.

Section 175-6 means that tenants in Watervliet may benefit from whichever local rule — whether this chapter or another city ordinance — provides the greater protection or higher standard. If a landlord claims compliance with one code while potentially falling short of a stricter overlapping requirement, that conflict may be relevant to a housing complaint or code-enforcement inquiry. Tenants seeking to understand which standard applies to their building can consult the city's code enforcement office or a local tenant-rights organization for general guidance.
