Plain English

Watervliet, N.Y., Code of Ordinances ch. 175 § 175-38 establishes baseline safety standards for all mechanical systems and equipment in buildings, including plumbing, heating, electrical, ventilation, elevators, and similar installations. Under this provision, such systems must be installed, located, and maintained so they do not endanger health or welfare, create structural hazards, pose fire or radiation risks, or generate excessive noise. The rule also requires that equipment vulnerable to freezing be protected against it, and that any moving parts posing a hazard be guarded to prevent accidental contact.

For Property Managers

Property owners and managers operating under Watervliet, N.Y., Code of Ordinances ch. 175 § 175-38 generally keep all mechanical systems — from plumbing and wiring to elevators and HVAC — properly installed and routinely maintained so they remain safe under normal use. Compliant operators take steps to winterize any equipment susceptible to freeze damage before cold weather arrives and ensure that exposed moving parts are fitted with appropriate guards. Maintaining documentation of inspections, repairs, and equipment upgrades is a common practice that supports ongoing compliance with this provision.

For Tenants

Watervliet, N.Y., Code of Ordinances ch. 175 § 175-38 gives tenants a basis to raise concerns when building mechanical systems — such as heating, electrical wiring, plumbing, or elevators — are poorly maintained, create hazards, or generate excessive noise. Tenants who observe conditions that appear to violate this provision, such as unguarded moving parts or unprotected pipes that have frozen, may report those conditions to the local code enforcement or housing authority. Tenant-rights organizations can help residents understand how to document issues and what local complaint or inspection processes may be available.
