Plain English

Section 175-28 of Watervliet's Code of Ordinances establishes minimum physical standards for nonhabitable spaces in multiple dwellings, covering ceiling height, artificial lighting, and ventilation. Nonhabitable rooms such as kitchenettes, bathrooms, laundry rooms, and furnace rooms must meet specific light and airflow thresholds, while stairways must be lit well enough for safe use. Mechanical or natural ventilation options are defined for bathrooms and kitchenettes, and spaces housing central mechanical equipment must vent directly to the outside without recirculating air to the rest of the building. Attics, crawl spaces, and spaces below flat roofs also require ventilation sized and positioned to limit moisture damage to structural components.

For Property Managers

Operators of multiple dwellings in Watervliet should ensure that all nonhabitable spaces covered by § 175-28 meet the code's height, lighting, and ventilation requirements before units are occupied and as part of ongoing maintenance. Compliant operators typically verify that bathrooms and kitchenettes have either adequate openable window area or mechanical exhaust fans meeting the cubic-feet-per-minute minimums stated in the provision, and that stairways are continuously lit for safe passage. Equipment rooms containing heating or air-conditioning systems are kept vented directly to the exterior, with no recirculation of that air into occupied areas of the building, and attic and crawl-space ventilation openings are sized and positioned to prevent moisture-related structural deterioration.

For Tenants

Tenants living in multiple dwellings in Watervliet have an interest in knowing that § 175-28 sets enforceable minimum standards for the nonhabitable spaces they use, including bathrooms, kitchenettes, laundry rooms, and stairways. If a bathroom lacks adequate ventilation, a stairway is poorly lit, or a utility space appears to recirculate equipment-room air into the building, these conditions may constitute code violations that can be reported to the City of Watervliet's code enforcement office. Tenant-rights organizations can help residents understand how to document conditions, what to include in a complaint, and what remedies may be available under local housing code.
