Plain English

Section 175-13 of Watervliet's Code of Ordinances ch. 175 establishes the process by which the city's enforcement officer responds to discovered violations of the housing chapter. When a violation is found, the officer is authorized to issue an appearance ticket to the property owner or any responsible party, as those terms are defined in the chapter. Alternatively, under § 175-13, the officer may bypass the appearance ticket and instead file a summons, complaint, or other accusatory instrument directly in Watervliet City Court.

For Property Managers

Under § 175-13, a compliant property owner or manager ensures that all requirements of Watervliet Code ch. 175 are met so that the enforcement officer has no grounds to issue an appearance ticket or initiate court proceedings. Operators generally maintain records demonstrating ongoing compliance and respond promptly to any notices from the enforcement officer. Receiving an appearance ticket or a court summons under this section signals that formal action has been initiated, and owners typically consult qualified legal counsel familiar with Watervliet City Court procedures.

For Tenants

Section 175-13 gives tenants context for understanding how Watervliet enforces housing code violations: the city's enforcement officer can issue an appearance ticket to an owner or responsible party, or go directly to Watervliet City Court with a summons or complaint. Tenants who believe a violation of ch. 175 exists may report concerns to the city's enforcement office to trigger this process. Local tenant-rights organizations can help tenants understand how a documented violation under § 175-13 might be relevant to their situation.
