Plain English

Section 175-12 of Watervliet's Code of Ordinances establishes the authority of the city's enforcement officer to enter and inspect residential dwellings, rooming houses, and related premises at reasonable times after presenting proper identification. Occupants and persons in charge of those spaces are required to allow access for these inspections. The enforcement officer may also create supplemental rules and regulations—subject to City Council approval—that carry the same legal weight as the ordinance itself, with equivalent penalties for violations.

For Property Managers

Under § 175-12, property owners and managers operating dwellings or rooming units in Watervliet should be prepared to facilitate inspections by the city's enforcement officer or an authorized representative at reasonable times. A compliant operator generally ensures that tenants are aware that access must be granted upon proper identification being shown, and keeps records of any inspection visits. Rules and regulations adopted under this section carry the same force as the ordinance, so operators typically stay current with any supplemental regulations filed with the City Clerk.

For Tenants

Section 175-12 requires that occupants of dwellings and rooming units in Watervliet allow the enforcement officer access at reasonable times, but the officer must show proper identification before entry. Tenants retain the protection that inspections occur only at 'reasonable times,' which provides a baseline limit on when access can be demanded. Tenants who have questions about whether an inspection was conducted properly under § 175-12 may wish to contact a local tenant-rights organization or consult the City Clerk's office to review any filed rules and regulations.
