Troy, N.Y., Code of Ordinances ch. 176 § 176-3
A. The provisions of the Housing Code shall apply to all structures used for human habitation, which are now or may become in the future substandard with respect to structures, protection against fire hazard, equipment or maintenance, inadequate provisions for light and air, lack of proper heating, unsanitary conditions, and overcrowding, or otherwise may be deemed to constitute a menace to the safety, health or welfare of their occupants; except as provided in § 176-4D . The existence of such conditions, factors, or characteristics adversely affect public safety, health and welfare and lead to the continuation, extension and aggravation of urban blight. Adequate protection of the public, therefore, requires the establishment and enforcement of these minimum housing standards. B. All lots, plots, or parcels of land on which residential buildings, buildings of mixed occupancies or accessory structures are located shall comply with appropriate provisions of this housing chapter. C. Travel trailers and mobile homes. All moveable units used for human habitation, and the areas, grounds or parcels on which they are located, insofar as they are applicable thereto, shall comply with the requirements of this housing chapter.

Plain English

Section 176-3 of Troy, N.Y., Code of Ordinances ch. 176 establishes the scope of the city's Housing Code, applying it to all structures used for human habitation that fall below minimum standards in areas such as structural integrity, fire protection, heating, sanitation, lighting, ventilation, and overcrowding. The provision also extends coverage to the land parcels on which residential and mixed-use buildings sit, as well as to moveable units like travel trailers and mobile homes and the grounds where they are located. The city's stated rationale is that substandard conditions harm public safety, health, and welfare and contribute to urban blight, making the enforcement of these minimum standards a public necessity.

For Property Managers

Property owners and managers operating in Troy should be aware that § 176-3 casts a broad net, covering not just the interior of habitable structures but also the surrounding lots and any moveable units used for human habitation on those parcels. Compliant operators generally ensure that all residential and mixed-use buildings—along with their grounds—meet the Housing Code's minimum standards for structure, fire safety, heating, sanitation, light, air, and occupancy levels. Keeping records of routine inspections and maintenance activities is a common practice among operators who want to demonstrate ongoing compliance with ch. 176.

For Tenants

Under § 176-3 of Troy's Housing Code, tenants living in any structure used for human habitation—including mobile homes and travel trailers—have the protection of the city's minimum housing standards covering conditions such as heating, sanitation, structural safety, and overcrowding. If a tenant believes their dwelling falls below these standards, general enforcement paths include filing a complaint with the appropriate Troy municipal housing or code enforcement office, raising the Housing Code violation as a defense in relevant legal proceedings, or reaching out to a local tenant-rights organization for guidance. Because § 176-3 explicitly states that substandard conditions affect public welfare, documented complaints about such conditions are generally within the scope of what the city's enforcement framework is designed to address.
