Plain English

Troy, N.Y., Code of Ordinances ch. 176 § 176-26 establishes that the people who live in dwellings, multifamily dwellings, and dwelling units — as well as owners or operators of rooming houses — share responsibility for maintaining those spaces. Occupants are required to keep their occupied areas clean and sanitary, dispose of rubbish and garbage in designated containers or approved facilities, and use plumbing fixtures properly and responsibly. The rule draws a clear line between what residents are expected to maintain themselves and the broader maintenance obligations addressed elsewhere in the chapter.

For Property Managers

Under Troy, N.Y., Code of Ordinances ch. 176 § 176-26, owners and operators of rooming houses carry direct maintenance responsibilities for those properties. Compliant operators generally ensure that required rubbish and garbage containers are provided and accessible, as referenced in §§ 176-20J and 176-20K, so that occupants have the means to fulfill their own disposal obligations. Keeping records of container placement, condition, and any notices issued to occupants about sanitation standards is a practice commonly associated with ongoing compliance.

For Tenants

Troy, N.Y., Code of Ordinances ch. 176 § 176-26 places specific sanitation duties on occupants, including keeping living spaces clean, disposing of rubbish and garbage in the designated containers, and using plumbing fixtures with reasonable care. Tenants who believe their landlord has failed to provide the required containers or facilities referenced in §§ 176-20J and 176-20K may have grounds to raise that failure when responding to a maintenance or code-compliance matter. Local tenant-rights organizations or the City of Troy's code enforcement office can be resources for understanding how these responsibilities are applied in practice.
