Troy, N.Y., Code of Ordinances ch. 176 § 176-11
Vacating of declared building
Operative Text
A. Any dwelling, multifamily dwelling or structure which has been declared and placarded as unfit for human habitation by the Director of Code Enforcement and/or his/her designee shall be vacated within a reasonable time as required by the Director of Code Enforcement and/or his/her designee; and it shall be unlawful for any owner or operator to let to any person for human habitation said dwelling, multifamily dwelling, dwelling unit or structure; and no person shall occupy any dwelling, multifamily unit or structure which has been declared or placarded by the Director of Code Enforcement and/or his/her designee as unfit for human habitation after the date set forth in the placard. B. Occupancy of building. No dwelling, multifamily dwelling or structure which has been declared or placarded as unfit for human habitation shall again be used for human habitation until written approval is secured from the Director of Code Enforcement and/or his/her designee. The Director of Code Enforcement and/or his/her designee shall remove such placard whenever the defect or defects upon which the declaration and placarding action were based have been eliminated. C. Report of notice to vacate. The Director of Code Enforcement and/or his/her designee shall furnish a copy of each notice to vacate a building to any official of any other department of the City administration concerned therewith (Police Department, Fire Department, etc.). A copy of notice to vacate must also be furnished each affected tenant of said building to be vacated.
Troy, N.Y., Code of Ordinances ch. 176 § 176-11 establishes what happens when the Director of Code Enforcement officially declares a dwelling or structure unfit for human habitation. Once such a declaration is made and a placard is posted, the building must be vacated by a deadline set by the Director, and it cannot be re-occupied until the Director issues written approval confirming that the underlying defects have been corrected. The provision also requires that notice of the vacate order be shared with relevant city departments and with each affected tenant in the building.
Plain English — not legal advice.
Under Troy, N.Y., Code of Ordinances ch. 176 § 176-11, a compliant property owner or operator does not rent or allow occupancy of any unit that has been officially placarded as unfit for human habitation. Operators generally ensure that all cited defects are fully remediated and that written re-occupancy approval is obtained from the Director of Code Enforcement before allowing any tenant to return. Renting or re-occupying a placarded unit before that written clearance is issued constitutes a violation of this section.

Troy, N.Y., Code of Ordinances ch. 176 § 176-11 entitles each affected tenant to receive a copy of any notice to vacate issued for their building, so tenants should expect written notification directly from the Director of Code Enforcement or a designee. A building that has been placarded cannot lawfully be re-rented or re-occupied until the Director issues written approval, which means tenants have a basis to question any landlord who attempts to move residents back in before that clearance is granted. Tenants who believe their rights under this provision have been violated may consider contacting the Troy Code Enforcement office, a local tenant-rights organization, or seeking guidance from a housing attorney.
