Syracuse, N.Y., Rev. Gen. Ord. ch. 27 § 27-42
Fire resistance ratings
Operative Text
(a) The fire resistance rating of floors, walls, ceilings, and other elements and components shall be maintained at the level required by the building code in effect at the time of the construction or most recent change of occupancy of said building. (b) All required fire rated doors or smoke barriers shall be maintained in good working order, including all hardware necessary for the proper operation thereof. (1) The use of door stops, wedges and other unapproved hold-open devices is prohibited.
Syracuse Rev. Gen. Ord. ch. 27, art. 5 § 27-42 establishes that the fire-resistance ratings of structural and enclosing elements—floors, walls, and ceilings—must be kept at the level required by the building code that was in force when the building was constructed or last changed in occupancy. Fire-rated doors and smoke barriers must be kept in good working order, along with all associated hardware. Propping these doors open with door stops, wedges, or any other unapproved hold-open device is expressly prohibited.

Under Syracuse Rev. Gen. Ord. ch. 27, art. 5 § 27-42, compliant property operators routinely inspect fire-rated assemblies—including floors, walls, ceilings, fire doors, and smoke barriers—to confirm they meet the fire-resistance ratings required at the time of original construction or the most recent change of occupancy. Operators also verify that all door hardware (closers, latches, seals) is fully functional and that no door stops, wedges, or other unapproved hold-open devices are in use anywhere on the property. Routine documentation of these inspections can help demonstrate ongoing compliance with the provision's maintenance requirements.

Syracuse Rev. Gen. Ord. ch. 27, art. 5 § 27-42 gives tenants a basis to raise concerns when fire-rated doors are propped open, missing hardware, or otherwise not functioning properly, or when walls, ceilings, or floors appear to have compromised fire-resistance ratings. Tenants who observe these conditions may report them to the City of Syracuse's code enforcement office, which has authority to inspect and require corrections. Tenant-rights organizations in the Syracuse area can also help residents understand how this provision applies to their building and what general enforcement paths are available.
