Syracuse Rev. Gen. Ord. ch. 27, art. 12 § 27-171 establishes the process and timeline for renewing a certificate of use in Syracuse. Business owners must submit a renewal application to the division of code enforcement at least 60 days before their current certificate expires, using the official form provided by the director of code enforcement. If a renewal is not obtained, the business may be ordered closed as unlawful under the 2010 New York State Property Maintenance Code until a valid certificate is issued. The renewal period is noted on the certificate itself when it is first issued.

For Property Managers

Under Syracuse Rev. Gen. Ord. ch. 27, art. 12 § 27-171, operators of rental properties or businesses subject to a certificate of use generally track their certificate's expiration date and submit a completed renewal application to the division of code enforcement no later than 60 days before that date. Compliant operators use the form provided by the director of code enforcement and do not wait for a reminder, since the provision explicitly states that a failure by the director to supply the form does not excuse the owner's obligation to comply. Failing to renew on time can expose a property or business to closure as an unlawful operation.

For Tenants

Syracuse Rev. Gen. Ord. ch. 27, art. 12 § 27-171 is relevant to tenants because a landlord's failure to maintain a valid, renewed certificate of use can result in the business or rental operation being deemed unlawful. Tenants who believe a property is operating without a current certificate of use may contact the Syracuse division of code enforcement to inquire about the property's compliance status. Tenant-rights organizations can also help explain how a certificate-of-use violation might be raised in a housing proceeding or complaint process.
