Enforcement
Operative Text
(a) Any person, firm, corporation or other entity who violates any prohibition of this revised general ordinance shall be guilty of a summary offense and, upon conviction thereof, shall be subject to the maximum fine allowable under the City Charter and applicable local law or ordinance for said violation. A separate offense shall arise for each day or portion thereof in which a violation occurs and for each section of this revised general ordinance found to be violated. (b) The city of Syracuse may also enforce this revised general ordinance through action in equity brought in New York State Supreme Court. In such an action, the city of Syracuse shall be entitled to recover all costs of litigation, including, without limitation, expert and attorney's fees. In the alternative the city may choose to enforce this revised general ordinance through city court in the manner provided by law.
Syracuse Rev. Gen. Ord. ch. 27, art. 10 § 27-154 establishes that violations of the city's housing ordinance are treated as summary offenses, with fines reaching the maximum allowed under the City Charter and applicable local law. Each day a violation continues counts as a separate offense, and each distinct section violated creates an additional offense. Beyond fines, the city can pursue enforcement through equity actions in New York State Supreme Court—where it may recover litigation costs, expert fees, and attorney's fees—or through city court proceedings.

Property owners and managers subject to Syracuse Rev. Gen. Ord. ch. 27, art. 10 § 27-154 should be aware that non-compliance can result in compounding daily fines, since each day a violation persists is treated as a new, separate offense. Operators who maintain properties in continuous compliance with each section of the ordinance avoid the risk of multiple simultaneous violations stacking into significant financial exposure. Compliant operators typically document corrective actions promptly and keep records showing that identified issues were resolved without delay.
