Operative Text

Schenectady, N.Y., Code of Ordinances ch. 210 § 210-4
A. The owner of a property constituting a rental property shall register the same with the Building Inspector within 60 days of the effective date of this chapter on a form approved by the Building Inspector. This form shall be known as a "landlord registration statement," which shall be signed by the owner under oath. B. It shall be unlawful for any owner to offer any unit for rent, or to rent any unit, or to allow any rental unit to be occupied without having first registered pursuant to this chapter as required herein within the time prescribed for such registration. Failure to receive notice of the registration deadline will not excuse failure to register rental property. It is the owner's responsibility to fulfill the requirements of this chapter.

Plain English

Schenectady, N.Y., Code of Ordinances ch. 210 § 210-4 requires that owners of rental properties register with the Building Inspector by submitting a signed, sworn landlord registration statement within 60 days of the chapter's effective date. Renting, offering to rent, or allowing occupancy of a unit without completing this registration is explicitly prohibited. Importantly, the rule places the burden of compliance squarely on the owner — not receiving a notice of the registration deadline does not excuse a failure to register.

For Property Managers

Under Schenectady, N.Y., Code of Ordinances ch. 210 § 210-4, compliant rental property owners obtain and complete the Building Inspector's approved landlord registration statement, sign it under oath, and submit it within the prescribed 60-day window before offering or renting any unit. Operators generally maintain records confirming that registration was completed prior to any tenancy beginning, since the ordinance makes it unlawful to rent or allow occupancy without prior registration. Because the ordinance explicitly states that failure to receive notice does not excuse non-compliance, proactive outreach to the Building Inspector's office is a common practice among compliant operators.

For Tenants

Schenectady, N.Y., Code of Ordinances ch. 210 § 210-4 establishes that a landlord must be registered with the Building Inspector before lawfully renting or allowing occupancy of any unit, which may be relevant to tenants who have questions about their landlord's compliance status. Tenants who believe their landlord may not have registered as required can inquire with the Schenectady Building Inspector's office, which administers the registration program.
