Section 108-48 of Rye, N.Y., Code of Ordinances ch. 108 establishes that the Building Inspector and authorized City personnel may enter properties during normal business hours—or at any time during an emergency—to carry out their official duties. The provision also places a corresponding obligation on owners, agents, operators, and occupants to provide access to all parts of a property that are within their control. Together, these two rules create a framework of authorized inspection access balanced with a duty to cooperate.

For Property Managers

Under § 108-48, property owners and their agents or operators are expected to ensure that authorized City personnel can reach all areas of the premises that are within their control during normal business hours or in an emergency. Compliant operators typically maintain clear access to all parts of the building, promptly respond to inspection requests, and avoid obstructing or delaying entry by authorized personnel. Keeping records of inspection visits and any communications with the Building Inspector's office is a common practice among well-managed properties.

For Tenants

Section 108-48 applies to occupants as well as owners, meaning tenants who control a portion of the premises share in the responsibility to provide access to authorized City personnel acting in their official capacity. Tenants generally have the right to confirm that anyone seeking entry is indeed authorized City personnel before granting access, and the provision limits routine entry to normal business hours outside of emergencies. Tenants who have questions about how this provision interacts with their lease or other tenant-protection rules may find it useful to consult a local tenant-rights organization or review Rye's broader housing code.
